A prominent constitutional law professor said Tuesday that Attorney General Mike Cox's challenge of federal health care reform is based on substantial legal issues and those who dismiss the effort are "uninformed and incorrect."

Randy Barnett, a professor of legal theory at the Georgetown University Law Center in Washington, D.C., said the health care bill signed into law by President Obama can be challenged based on its mandate that all uninsured individuals must purchase an insurance policy. In addition, its threat to eliminate all Medicaid funds for states that don't cooperate with the new system could be declared an abuse of federal authority.

"These claims are highly plausible. Whether they are ultimately successful at the Supreme Court is very hard to predict," Barnett said.

Cox is one of 14 state attorneys general who have joined in a lawsuit originated in Florida that claims the new law violates states' sovereignty. In a conference call with several Michigan reporters, arranged by Cox, Barnett said the health care bill's requirement to purchase insurance or face a federal fine is unprecedented.

"This is a claim of power by the federal government that has never been made before," he said. "It goes beyond any claims that the Supreme Court has dealt with."

The U.S. Constitution's commerce clause, he said, has never been applied to an economic "inactivity" by citizens — forcing them to purchase a product.
The commerce clause of the US Constitution (in Article 1 Section 8) allows the federal government to regulate commerce across state lines. However, in the case of ObamaCare, the commerce is intrastate as the feds don't allow healthcare insurance companies to operate across state lines, and even in that case it is a lack of commerce (ie -people not buying insurance versus commerce). Thus the commerce clause argument for allowing ObamaCare falls flat on its face.
In addition, the professor said that the federal threat to withdraw billions of dollars in Medicaid funding to states that fail to comply could be interpreted by the high court as "commandeering" of states' authority, as the attorneys general claim.

In the past, Washington has vowed to reduce highway funding by a relatively small amount to states that refused to comply with a mandated speed limit law or balked at raising their legal drinking age to 21. But threatening to cut off all Medicaid funding could be viewed as an unreasonably "coercive" act of Congress by the Supreme Court justices.

Pharmacist charged with 1st degree murder for forced abortion on girlfriend. Uh - how are other abortions any different?

So a Pennsylvania pharmacist gets his jollies off but gets his girlfriend pregnant. The new dad doesn't want to raise his child, so he tells the girlfriend to get an abortion. She concedes but changes her mind and leaves the butcher shop sans said abortion. What to do? Well, if you happen to be a pharmacist with a seared conscience, you administer drugs to your pregnant girlfriend that forces a miscarriage and thus kills your child. The pharmacist is now charged with premeditated murder of his 13-week old child. Thus begs the question - how is any other abortion not murder? Sayre police on Wednesday charged Orbin Eeli Tercero, 38, with criminal homicide of an unborn child, first-degree murder of an unborn child, aggra vated assault of an unborn child, aggravated assault, hindering apprehension or prosecution, and tampering with or fabricating physical evidence.

...The charges are based on the following events, according to police:

The victim, a 36-year-old woman from Sayre and a pharmacist at a Wegmans Market, said she had a two-year physical relationship with Tercero, also a Wegmans pharmacist.

Tercero was engaged to another woman at the time.

The victim, whose name is being withheld by this newspaper, told Tercero she was pregnant in mid-January.

Tercero told the woman he could use the drug misoprostol to induce a miscarriage. The victim told Tercero she would get an abortion instead.

The victim, however, made a Feb. 24 appointment for an abortion but changed her mind. She called Tercero to tell him she would keep the baby.

In late February, on the victim's birthday, Tercero visited her at home and used misoprostol he allegedly stole from Wegmans pharmacy to cause the miscarriage.

Without her knowing it, Tercero put one pill in her vagina, one in her juice and one in her water. She was 13 weeks pregnant at the time.

When the victim began to miscarry, she found a partially dissolved misoprostol tablet among the discharge.
Thus the logical question: what is the difference between an abortion with the moms consent and one without it? Either way, the baby meets in end by getting thrown into the equivalent of a wood chipper. Would the consent of a mother make the killing of a 1-year old toddler legal? If not, then why not? What's the difference between abortion and infanticide? Logic and reason give an answer: nothing.

The statists are upset that the American public is eating up socialism like they do apple pie. As usual, they are claiming that it is not the policy, but rather that it's not being articulated correctly:
Here's the thing, though - it's already an experiment that has been explicitly tried here and was a proven failure. From a prio post of mine back in November 2009: The First Thanksgiving Proved Socialism A Failure. This is an excerpt from pngusa and is found throughout the internet:
On August 1, 1620, a ship called the "Mayflower" left England with 102 passengers bound for the New World. The manifest included two groups. The Separatists, led by William Bradford, had fled their homeland and the oppressive Church of England under King James I in search of a home where they could live and worship God according to their own conscience. The Strangers sought the New World for other reasons. Together they formed the Pilgrims.

Their intended crossing to Virginia strayed off course, and they instead landed on Cape Cod -- outside the territory covered by the King's Charter. Thus, the Pilgrims were responsible for their own governance. Following the nine-week journey, the Pilgrims composed an agreement that would establish just and equal laws for all members of the new community. Indeed, the revolutionary ideas expressed in the Mayflower Compact were derived from none other than the Holy Bible.

Only then, on November 11, 1620, did the Pilgrims leave the Mayflower. A cold and barren wilderness awaited them. There were no friends to greet them, no houses to shelter them, nor stores of food to sustain them. That first winter was perilous, as half the Pilgrims died of starvation, sickness, or exposure.

When spring arrived, an Indian named Squanto taught the settlers how to plant corn, fish, use fertilizer, and stalk deer. Bradford wrote that Squanto was "a special instrument sent of God for their good beyond their expectations."

In October, following their first harvest, Governor Bradford set aside a day of thanksgiving. Squanto, his chief Massasoit, and other members of the tribe were invited to the thanksgiving feast. The Indians brought deer and turkeys, while the Pilgrim women cooked vegetables and fruit pies. The purpose of the feast was not to give thanks to the Indians or Mother Earth, as contemporary history textbooks commonly report, but as a devout expression of gratitude to God.

What modern history texts also omit is that the contract the Pilgrims brokered with their merchant-sponsors in London specified that everything they produce go into a common store, with each member entitled to one common share. In addition, all the land they cleared and the structures they built belonged to the community.

William Bradford, Governor of the new colony, realized the futility of collectivism and abandoned the practice. Instead, Bradford assigned a plot of land to each family and permitted them to market their own crops and other products, thereby unleashing the power of free enterprise. What Bradford had wisely realized was that these industrious people had no reason to work any harder than anyone else without the motivation of personal incentive.

Thus, what can only be called the Pilgrims' attempt at socialism ended like all other attempts at socialism -- in failure. What Bradford subsequently wrote about the experiment should be in every American history textbook. The lesson provided therein is invaluable.

"The experience that was had in this common course and condition, tried sundry years and that amongst godly and sober men, may well evince the vanity of that conceit of Plato's and other ancients applauded by some of later times; that the taking away of property and bringing in community into a commonwealth would make them happy and flourishing; as if they were wiser than God. For this community (so far as it was) was found to breed much confusion and discontent and retard much employment that would have been to their benefit and comfort. For the young men, that were most able and fit for labour and service, did repine that they should spend their time and strength to work for other men's wives and children without any recompense."

And what happened after collectivism was replaced by capitalism and the concept of private property?

"This had very good success, for it made all hands very industrious, so as much more corn was planted than otherwise would have been by any means the Governor or any other could use, and saved him a great deal of trouble, and gave far better content."

The Pilgrims soon found they had more food than they could eat, so they set up trading posts and exchanged goods with the Indians. The profits they realized allowed them to pay off their debts to the merchants in London. The success and prosperity of the original Plymouth settlement attracted more European settlers, setting off what came to be known as the "Great Puritan Migration."

Three hundred and eighty-two years later, Americans still set aside the fourth Thursday in November each year as a celebration of thanksgiving. Although this quintessentially American holiday has become more secular than religious, it was originated by devoutly Christian people who were expressing gratitude for the bounty brought forth by their labor and the blessings bestowed upon them by God.
It's been 389 years now since the landing, and 388 since the first Thanksgiving. It is one of the greatest history lessons in what forms of government work, and what does not. It is a shame our current leaders haven't learned the lessons from the earliest history of the United States. They haven't learned that socialism is a dismal failure - always is and always has been - and that to flourish, we as a people need to continually acknowledge God. 2 lessons that modern liberals loath. The modus operindi of elitist liberals who can't win a debate on the facts is character assassination. This is why liberals and their sycophantic suck-ups in the MSM are trying their best to paint the tea party movement as racist, sans any evidence whatsoever. Arianna Huffington recently went on MSNBC's "Morning Joe" and immediately went into character assassination mode on Rudy Giulian, but ended up being humiliated by  Scarborough, Rudy, and other guest Mort Zuckerman. As the subject of Florida's Senate race was broached, Huffington decided to attack the former Mayor of New York City rather than address the qualifications of Republican candidates Charlie Crist and Marco Rubio.
"Your judgment in people has not been stellar -- Bernard Kerik, anybody, so the fact that you're supporting Rubio now, I don't know exactly how seriously we should take it," irrelevantly spouted the liberal publisher.
Marvelously, some of the gentlemen on the panel didn't appreciate the cheap shot including Giuliani himself who finally said, "I come on here just to talk about Marco Rubio, you're attacking me on Bernie Kerik, you're attacking me on how I ran my presidential race. I imagine you're going to attack me on what I did in the Little League when I was a child"

This is indeed astonishing. The President of the United States — whose most important duty is to protect the citizens of this country — is publicly abjuring the use of nuclear weapons if we are attacked by chemical or biological weapons — both of which are known to all of us as Weapons of Mass Destruction, the dreaded WMDs.
What are we to make of this and the man who is adopting this policy? Does he hate us? Does he hate this country? What would he do if there was, for example, a massive small pox attack on the U.S.? Send in the infantry? Call in the Marines? Try to reason with whoever did it and recommend they negotiate as the fatal disease spreads to millions of people?
Now I detest nuclear weapons as much as the next person, but this approach seems — I hate to repeat myself, but I will — deranged. It also has very little to do with actually reducing nuclear weapons in the world. Again, it seems like the act of an extreme narcissist, someone who wants to parade himself as anti-nuke while ignoring the checks and balances that have, in fact, kept nuclear weapons in their silos for decades.
Deterrence has worked. And now Obama wants to abandon or diminish it at the very moment Russia is modernizing their arsenal. What a strange person. President Weirdo, indeed. As I said in my previous post, “good luck to us.”

President Barack Obama's election has inspired a record number of African-American candidates to run for Congress this year. What's surprising is that they're running as Republicans.
That has to go down as one of my favorite all time quotes in the Detroit News.
Say what? Have Obama's approval ratings been that shaky? Not quite. At this point, we're talking about African-Americans who merely have thrown their hats in the ring for the Republican nomination in their districts. Political oddsmakers don't give many of them much of a chance to win.

That's not something I celebrate, since I believe, as many of these candidates do, that black voters would benefit from having both parties competing for black support, along with that of other Americans. But since the Grand Old Party's conservative turns in the 1960s and 1980s, many African-Americans don't feel they left the party of Abraham Lincoln as much as the party left them.
That's simply not true and intellectually dishonest. The GOP is still the party of limited government and personal freedom and liberty, something the Democrat party is against both in the distant past with slavery as well as today by shackling minorities to government dependency via welfare, failed public schools, etc. It is still the party of Abraham Lincoln while the Democrat Party is still the party of slavery. The one thing that changed dramatically in the 1960s was welfare which had the effect of destroying the black family by replacing the father with the government.
At latest count, 33 African-Americans are running for Republican nominations to Congress, according to the Frederick Douglass Foundation, a 2-year old organization founded by chairman Timothy F. Johnson, vice chairman of the North Carolina Republican Party. That's the most black Republican congressional candidates since Reconstruction, the foundation's leaders believe.

They've been called Oreos, traitors and Uncle Toms, and are used to having to defend their values. Now black conservatives are really taking heat for their involvement in the mostly white tea party movement—and for having the audacity to oppose the policies of the nation's first black president.

"I've been told I hate myself. I've been called an Uncle Tom. I've been told I'm a spook at the door," said Timothy F. Johnson, chairman of the Frederick Douglass Foundation, a group of black conservatives who support free market principles and limited government.
If you want to know what true intolerance is, be a black conservative. It is liberals that are the most intolerant.
Johnson and other black conservatives say they were drawn to the tea party movement because of what they consider its commonsense fiscal values of controlled spending, less taxes and smaller government. The fact that they're black—or that most tea partyers are white—should have nothing to do with it, they say.
Couldn't have said that better myself, nor will I try. As I have said many times on this blog, it's not about race, but rather policy, and it is the latter that gave rise to the tea party movement, not the former. Yet, opponents have done their best to paint the tea party as racist even though I have reported from many tea parties and my pics included black people there. In fact, there are many black tea party participants that are simply ignored by the media. Incidentally, HotAir has probably the best headline along those lines: AP discovers that black tea party members exist. Black conservatives aren't anything new. The fact that the media are finally noticing is. Back in November, Glenn Beck had a special on black conservatives in America:

The mainstream left hates black conservatives almost as much as the media lynch mob. And make no mistake, it is the same kind of lynch mob that used to hang black people sans trial or even any semblance of due process. These days, people don't tend to get lynched from trees anymore. Instead, their character is lynched in the court of public opinion. Lives are ruined. It is especially done to black conservatives in prominent positions. Just ask this black man:
That's the way it's done these days to black conservatives.This is simply a form of slavery. That's right - slavery. Not to a plantation owner but to the state itself. The state sets certain rules and those that don't follow those rules - who veer off the chosen path - are vilified as Uncle Toms. It doesn't matter that the chosen path leads to misery and poverty. That's the whole point.
Keeping blacks down is a form of control that Democrats have become exceedingly efficient at. The same party that defended slavery, fought for it, segregated schools, filibustered the Civil Rights Act of 1964, came out later with welfare, good intentions on full displace, which has broken the black family and replaced the father with the government. Since that time, the poverty level has not changed on single bit. Then the victim mentality was installed by Democrats. Affirmative action separated people by their race. Us against them. Black versus white. Male versus female. Gay versus straight. The party of identity politics divides people and judges them by the color of their skin, not by the content of their character. Democrats have kept blacks down in the plantations of failed urban environments with failed public schools, doomed to continue voting for Democrats to get handouts that they have been convinced they are entitled to. And Democrats continue to to reap many votes from people's misery that they themselves have created.

Smartest President Evah And Baseball Fan Still Doesn't Know Where Chicago White Sox Play And Can't Name A Single Player

Last July, I created a post where Obama got the former home of the White Sox wrong: Video: White Sox Fan Barack Obama Doesn't Know Where White Sox Play.  He calls himself a baseball fan, especially of the Chicago Whit Sox. But he gaffed when identifying where they play. the reason this is post-worthy is that the MSM would have been all over Bush had he made such a gaffe. Or Palin. or any other Republican. Here is the Obama interview with Bob Costas. The gaffe occurs at the 3:15 mark where Obama thinks the White Sox play at "Cominskey Field." (It's really Comiskey Park, but Cominskey rhymes with Alinsky so there's that):

Detroit Tries To Raze 3,000 Abandoned Homes, Fails After Demolition Stopped After First Home Due To Environmental Concerns!

Those running the city of Detroit are so incompetent that they can't even bulldoze an abandoned house without an epic fail. In essence, Detroit is incompetent at being incompetent. A total fail. Mayor David Bing, who I think is a sharp improvement in leadership compared to what Detroit had for a long time, promised that 10,000 dilapidated, abandoned buildings would be razed. 3,000 was a good start last week, but demolitian was halted by a single person before the first house was leveled because, of all things, environmental concerns. City officials still were trying to determine what went wrong Friday, one day after a state inspector halted the demolition of the first house of a demolition blitz.
With Detroit, it's like the ending of any segment in Cops, "what'd I do? What'd I do?"
Detroit officials say the hiccup shouldn't halt efforts to raze 3,000 structures this year, but they're unsure whether the home on Lewerenz contained untreated asbestos. The rubble from the house remained Friday, as did worries among neighbors of exposure to the now-banned building material linked to cancer.
The only cancer in Detroit is the kind I refer to as Democrat hegemonic domination.
State officials only learned of the city's federally funded demolition blitz -- which Mayor Dave Bing touted in his State of the City speech last week -- through the media. The state said the city didn't file a required 10-day notice with the Department of Natural Resources and Environment over its plans to raze the house. Such a notice would include whether the house has asbestos.

"We didn't know about the project until we read about it in the paper," said Robert McCann, spokesman for the state agency.

State and city officials weren't sure Friday if the Lewerenz house had asbestos and, if so, whether it was properly removed. ...

Detroit Mayor Dave Bing's plan to demolish 3,000 crumbling homes and buildings this year to improve city neighborhoods was abruptly halted Monday after a state agency accused the city of violating state and federal laws.

The Department of Natural Resources and Environment said the city began demolition last week without testing for asbestos, a carcinogen commonly found in many older Detroit structures. The city also failed to notify the state of its demolition plans as required by federal law, which is another serious violation, said DNRE spokesman Robert McCann.

City officials said Monday that they unknowingly violated federal regulations because they were following the past administration's practice of demolishing structures without testing for asbestos. "When this was brought to our attention, we ceased immediately," said Carla Henderson, director of Buildings and Safety Engineering Department.
Uh - isn't this city officials' job to know such things? And they're pawning it off by saying they were litening to ... Kwame Kilpatrick??? The felon?

The halt to demolition work is a blow to Bing, who less than two weeks ago promised in his State of the City address to promptly raze crumbling houses in the first phase of a larger plan to demolish 10,000 structures over four years.

In interviews with the Free Press on Monday, city officials expressed embarrassment that work was abruptly shut down last week at a home in southwest Detroit, and said they had no idea they were violating state and federal regulations.

They blamed the foul-up on their decision to follow what they say was the practice of ex-Mayor Kwame Kilpatrick's administration of demolishing buildings without testing for asbestos or giving the state advance notice.
Again, that last part is just a sign of utter incompetence. Not mentioned in the articles regarding the most recent debacle is the fact that Detroit has been under Democrat hegemonic domination  for the past 50+ years.The situation that Detroit is in can't be pinned entirely on the politicians though. I pin much of the blame on the willfully ignorant electorate. With all the failed policies of the Democrat party, who do Detroit residents vote for? Democrats that have killed the hope in their hearts, that's who. By wide margins. In fact, Detroit is the most liberal city in the U.S. if one goes by voting record:
2008 General Election results-DEM: 96.93% GOP: 2.65%
2006 General Election results-DEM: 95.05% GOP: 4.33%
2004 General Election results-DEM: 93.61% GOP: 5.93%
The Stockholm Syndrome on a massive scale. And it's getting worse as the above numbers indicate.

Judge Napolitano: "Congress Spends More Time Avoiding And Evading The Constitution Than Upholding It"

And indeed it is true. The Constitution is now simply a stumbling block to what congresscritters want to do. They go through contortions that make a pretzel seem simple by comparison to argue, if in fact you can call it that, that their actions are constitutional. Here's Napolitano:
When asked about the constitutionality of ObamaCare, legislators had no answer. Many tried and fell flat on their faces. Some Democrats have given answers to such a challenge in a way that can only be labeled as 'stupid.' Some, like Sen. Merkley claim that two words - General Welfare - let them do whatever they want thus rendering the rest of the Constitution irrelevant. John Conyers claimed a nonexistent "good and welfare" clause, among other clauses he couldn't name. And then there was Phil Hare, who said“I don’t worry about the Constitution on this”. Of course he doesn't. Pelosi had a better answer: "are you serious?" That was it. Sen. Leahy says that nobody questions such authority (I beg to differ). Sen. Warner totally dodged the question by talking about telephones. Sen. Mary Landrieu dodged the question altogether instead referred the questioner to constitutional lawyers! Sen. Blanch Lincoln claimed that the U.S. Constitution charges Congress with "the health" of the people. Pro-life traitor Ben Nelson (D-Nebraska), who traded the lives of unborn babies for 30 pieces of silver, can't even answer that question before he was re-asked by CNS News. And Sen. Bob Casey is not sure if there's 'a specific Constitutional provision'. Don't you all feel much better now about the Constitutional competence of our lawmakers now? The White House, of course, claims no 'legitimate' constitutional concern. Obama himself said that he doesn't really care how things get done as long as they do. So who's left to defend our founding document? The courts. Unfortunately, the same politicians that have abdicated their oath to uphold the constitution have been appointing activist judges to do the same.

John McCain: Maverick? Who, me?

Every episode of Cops has at least one obligatory arrest scene with a perp, after a high speed chase, doing the frog walk while exclaiming "what'd I do? What? Me? Me???" Well, that's basically John McCain now. From The Washington Post via memeorandum:
Arizona Sen. John McCain is trying to shake loose the mantle of the maverick brand he shared with former Alaska governor Sarah Palin in 2008.
"I never considered myself a maverick," he told Newsweek. "I consider myself a person who serves the people of Arizona to the best of his abilities."
Palin, the magazine reports, apparently didn't get the message, and urged "fans four times in 15 minutes to send McCain the Maverick back to Washington" during a recent join appearance with the Republican officeholder at a fairground outside Tucson.

Of course he is doing this because of stiff competition from an actual conservative - J.D. Hayworth. Shameless. Just shameless. But what else do you expect from a RINO? The sooner he's primaried out, the better for the GOP.
